These Terms of Service ("Terms") govern your use of our services provided by Fine Productions Oy ("Icefiery," "we," "us," or "our").

BY USING OUR SERVICES, YOU AGREE TO THESE TERMS. IF YOU DON'T AGREE, STOP USING OUR SERVICES IMMEDIATELY.

We update these Terms from time to time, so please check this document periodically. We may notify you of changes via email or through our service.

1. About Our Services

Icefiery provides an image CDN and management platform that allows you to upload, transform, and serve images through our API and global CDN. Our services include:

  • Image upload and storage
  • On-the-fly image transformations
  • Global CDN delivery
  • Local development tools via Docker
  • API access for integration

We may modify or enhance our services over time, and may offer additional features either free or for additional fees.

2. Your Account

When you register, you'll need to provide accurate contact information. You're responsible for:

  • Keeping your login credentials secure
  • Notifying us immediately of any unauthorized use of your account
  • All activity that occurs under your account

You may terminate your account at any time through your account settings or by contacting us. We may suspend or terminate accounts that violate these Terms or for other legitimate business reasons.

3. Acceptable Use

You agree to use our services only for lawful purposes. You may not:

  • Upload illegal, harmful, or offensive content
  • Use our services to infringe on others' intellectual property rights
  • Attempt to disrupt or compromise our services
  • Use our services to develop competing products
  • Violate any applicable laws or regulations

You're responsible for all content uploaded to your account, including content uploaded by your end users, employees, contractors, or anyone else who accesses our services on your behalf or with your permission ("Authorized Users"). You must ensure that all Authorized Users comply with these Terms and applicable laws. Any violation by your Authorized Users will be considered a violation by you.

4. Your Content

You retain ownership of all images and content you upload to our services. By using our services, you grant us permission to:

  • Store, process, and deliver your content as part of our services
  • Make technical modifications necessary to provide our services (like format conversions)

We don't claim ownership of your content, but we need these permissions to operate our service effectively.

5. Privacy

We respect your privacy and handle your data according to our Privacy Policy. Please review it to understand how we collect, use, and protect your information.

6. Pricing and Payments

We offer both free and paid plans. Pricing is available on our website at https://icefiery.com/pricing

  • Fees are non-refundable
  • You're responsible for all applicable taxes
  • We may change pricing with reasonable notice
  • Failure to pay may result in service suspension

7. Service Availability

We strive to provide reliable service but cannot guarantee 100% uptime. Our services are provided "as is" without warranties of any kind.

8. Intellectual Property

Our services, including our API, documentation, and platform, are protected by intellectual property laws. You may use our services as permitted by these Terms, but you don't acquire any ownership rights in our technology.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • WE PROVIDE OUR SERVICES "AS IS" WITHOUT WARRANTIES
  • WE'RE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
  • OUR TOTAL LIABILITY TO YOU WON'T EXCEED THE FEES YOU'VE PAID US IN THE PAST 12 MONTHS

10. Indemnification

You agree to defend and hold us harmless from claims arising from your use of our services or violation of these Terms.

11. Content Removal

We respect intellectual property rights. If you believe content on our platform infringes your rights, please contact us with details.

We reserve the right to review, monitor, and remove any content at our sole discretion, including content that:

  • Violates these Terms or applicable law
  • May harm our services, users, or reputation
  • We determine is inappropriate for our platform

While we're not obligated to monitor content, we may do so to ensure the quality and safety of our services. We'll make reasonable efforts to notify you before removing content when practical, but immediate removal may be necessary in some circumstances.

  • Your access to paid features will end

  • Sections of these Terms that should survive (like liability limitations) will continue to apply

  • If any provision is found invalid, the rest remains in effect
  • We may assign these Terms; you may not without our consent
